The intent from the outset was to secure a pair of hosting providers, one
primary one backup.  The cloudscale.ch offer seems broader and more long
term, so independent of the ToS issue I would be leaning towards them as
primary with DigitalOcean as the backup.  If the ToS issue removes
DigitalOcean from the running then I'm sure we can find an alternate, so
we can continue keeping our eyes open.

The ToS issue has to be resolved, at least. I was a little surprised at your earlier response that you don’t have a direct contact with them. Am I following right that you got a grant for hosting from them, without ever interacting with a specific person over there? If that’s right, just for my understanding, how did that come about?

We have a separate contact we can hopefully use to connect us to their legal department. It’s pretty indirect, which is why I was holding out for someone who might have at least some of the background of what’s going on here already. But we can work with it if you still want to proceed with DigitalOcean too, which it sounds like you do.
