You mean by dragging a box around them, or one at a time?
In the former case it also picks up the top text, telling the user that the lower text must extend invisibly outwards.
In the latter case it only picks up the circles, which is not confusing at all.
If one selects the lower text and raises it above the adjoining circle, then clicking on the circle does select the text, which is clearly seen by its visible bounding box to extend beyond both adjoining circles. That is, the text box is wider than and lies over the circles.
It all makes sense to me.
